TikTok to pay Alabama US$100mil under pre-trial settlement
TikTok agreed to pay Alabama at least US$100 million in a pre-trial settlement, avoiding a jury trial over child safety claims. The video platform also accepted two-hour daily time limits and restricted access for children from midnight to 6am. Alabama had sued TikTok and ByteDance in April 2025, alleging the app was engineered to addict young users. This settlement follows similar cases against TikTok and contrasts with Meta's strategy of going to trial, which resulted in a US$375 million payment in New Mexico and an US$18 billion settlement in August.
TikTok's US$100 million settlement with Alabama, potentially rising to US$300 million, reflects a clear strategy to avoid public scrutiny. Unlike Meta, which faced a US$375 million jury order in New Mexico and an US$18 billion settlement in August, TikTok consistently settles. This approach keeps internal safety documents and executive testimony out of open court, protecting its brand and operational details from competitors and regulators.
For Asian tech companies, particularly those with global ambitions, TikTok's approach sets a precedent. It shows a willingness to pay significant sums to manage legal risks quietly. This could influence how other platforms, especially those from China facing similar regulatory pressures in Western markets, strategize their own legal defenses. The cost of avoiding public trials is high, but the alternative for Meta proved even higher.
The thing to watch is whether this settlement encourages more US states to pursue similar litigation against TikTok. The Alabama attorney general's office secured a minimum US$100 million payout within 45 days. This success could incentivize other states to file their own lawsuits, seeking similar financial resolutions rather than lengthy, uncertain trials.
