Feds accuse China of ‘systematic’ distillation of U.S. AI models
The U.S. government has accused several Chinese AI companies, including DeepSeek, Moonshot AI, Alibaba, MiniMax, StepFun, and Z.AI, of systematically distilling U.S. frontier AI models. A joint advisory from the NSA, CISA, and FBI alleges these companies have routed millions of data requests to U.S. models like Anthropic’s Claude, OpenAI’s ChatGPT, Google Gemini, and xAI’s Grok since at least late 2024. The U.S. agencies claim these interactions, involving billions of tokens, are used to enhance domestic Chinese AI models. This practice is described as a core component of China’s AI industrial policy, with companies employing sophisticated tactics to avoid detection, such as spreading requests across multiple accounts and platforms.
The U.S. government’s accusation of systematic distillation of American AI models by Chinese firms like DeepSeek and Moonshot AI points to a significant challenge for intellectual property in the AI sector. This is not merely about individual instances of data use; the advisory frames it as an industrial-scale effort central to China’s AI development strategy, involving billions of tokens and millions of exchanges since late 2024. The named Chinese companies allegedly used these interactions to train their own models, improving capabilities in areas such as agentic functioning, coding, and data analysis. For Asian tech professionals, this development underscores the growing tension in AI development and the increasing scrutiny on data sourcing. The sophisticated methods described, including using proxies and third-party aggregators to obfuscate user metadata, suggest a determined effort to circumvent existing safeguards. The thing to watch is how this impacts future collaborations and data-sharing policies between U.S. and Chinese AI entities, potentially leading to stricter controls or new regulatory frameworks that could affect the broader Asian AI ecosystem. While the U.S. government has previously made similar accusations, this advisory specifically details the scale and methods, naming companies and specific models involved. This level of detail suggests a more concerted effort by U.S. agencies to address what they perceive as systematic intellectual property theft in the AI domain, moving beyond general warnings to specific allegations against companies like DeepSeek and Moonshot AI.
