Nine individuals, including employees from Nvidia and Super Micro's Taiwan units, have been indicted for illegally exporting AI servers to China. The Keelung District Prosecutors’ Office announced the charges, which include breach of trust and document forgery. The alleged scheme involved making it appear that 130 B300 servers ordered from Super Micro would be used in Taiwan. However, 74 of these servers were ultimately delivered to Chinese customers through various routes, including transshipments via Indonesia, Japan, and Hong Kong. Taiwanese customs officials intercepted the remaining 56 servers, preventing their export to Japan.

This indictment of Nvidia and Super Micro employees in Taiwan underscores the escalating challenges in enforcing US export controls on advanced AI hardware destined for China. The alleged scheme, involving 130 B300 servers, highlights the sophisticated methods used to circumvent restrictions, with shipments routed through multiple Asian countries. Taiwan, as the world's largest producer of advanced chips, faces increased pressure to tighten its own export controls and maintain its international image amid these incidents. The involvement of employees from major semiconductor companies like Nvidia and Super Micro suggests a deep-seated issue within supply chains. The fact that 74 servers reached Chinese customers despite rigorous internal controls points to the significant profit incentives driving these illegal exports. This situation will likely lead to heightened scrutiny and compliance costs for companies operating in the region, impacting the broader AI supply chain in Asia.
